TERMS AND CONDITIONS
Thank you for joining Interlinks. Our entire staff welcomes you to the exciting world of the Internet and the World Wide Web. (All customers agree to accept responsibility for receipt of e-mail communications. This includes but is not limited to, monthly invoicing, notice of changes, notice of system maintenance, special information bulletins, etc.) 1.Your Interlinks Account Your new Interlinks account allows a single user access to the Internet and World Wide Web Services. The use of Email, Newsgroups, IRC, WWW browsing, website hosting, FTP and Telnet functions are all available 24 hours a day. Your account is allocated a maximum of 5 megabytes of storage space and 250 megabytes of monthly throughput, for the hosting of a Personal Web Site. Additional storage and throughput may be purchased. Should you exceed quotas at anytime during a month, you will automatically assume any additional charges to cover the additional usage. The content of this site must not derive any economic benefit to the account holder or representation on behalf of the account holder. All commercial type web sites are to be reported to Interlinks. A monthly storage fee and usage fee is charged to all Commercial Web Sites. If an unauthorized Commercial Web Site is discovered, the account will be invoiced for all previous months that it has been installed. Other services such as commercial web design, script hosting, email aliasing, virtual domain hosting are also available for additional fees. Please call (905)404-0810 to arrange Commercial Web Sites. All account services are provided on a month to month basis. Due to the technical nature of our industry, terms and conditions are subject to changes without notice. 2.Payments All Interlinks accounts automatically renew on the 1st of each month unless we have received notification of cancellation in accordance with paragraph 4 below. Credit Card Accounts will be placed into Interlinks' invoicing cycle and your account will automatically be billed on or about the 1st day of each month. Pre-Authorized Payment from your bank account will be withdrawn on or around the 1st day of each month. Please see terms on the Pre-Authorization form. Hourly use Interlinks accounts must be paid upon receipt of invoice via Email. All hourly billed invoices are due and to be paid immediately upon receipt of e-mail. Returned Payments All cheques or automatic payments returned to us for any reason will be charged a $25.00 administration fee. Overdue Accounts - Overdue accounts are subject to an interest charge of 1 % per month. 3.Software The software that you receive from Interlinks is copyright protected, and is supplied for the sole use of the single use account holder. Transfer of use or copying of software is prohibited and unlawful. 4.Cancellation of Service Interlinks requires 30 day written notice of cancellation. Customers will be responsible for all charges incurred, including the costs of collections or legal action, if necessary. Refunds for Interlinks service may be granted by Interlinks, at our sole discretion, within five days from the original date of initiation of the account. 5.Usage YOU REPRESENT THAT YOU ARE AT LEAST EIGHTEEN (18) YEARS OF AGE. You are fully responsible for how your account is used and all activities conducted through your account. The Internet is a powerful resource that must be used responsibly for legal activities only. Interlinks reserves the right to terminate any user account at any time without refund or notice as a result of any of, but not limited to, the following activities: 1) Hacking: Defined as keeping "hacking tools" or attempting or threatening the security of any system or resource. Suspected hackers will be turned over to proper legal authorities. 2) Non-payment for services. 3) Mail-bombing, Spamming (repeated postings) or any activity that shows malicious action towards another Internet or network system user. 4) Any action that brings negative press, online recognition or identification. 5) Storage of any illegal or pirated software. 6) Any activity that hinders the technical or business operations of Interlinks or any other Internet or network provider. Users guilty of accidental actions will not be excused from account termination. Should you have any questions concerning the proper use of any service function, please consult a Customer Support Representative at (905)404-0810. Interlinks' services may only be used for lawful purposes. Reproduction or transmission of any material in violation of any local, provincial, federal, or international law or regulation is prohibited. This includes, but is not limited to: lascivious, indecent or obscene material, transmission of material protected by trade secret or using your account to make, create, solicit or transmit any obscene or indecent material to or from any person under eighteen (18) years of age. You shall defend, indemnify and hold harmless Interlinks from and against any and all claims, liabilities and expenses, including attorneys fees resulting from your use of the service or your account in an unlawful manner or otherwise in violation of the Terms and Conditions. At Interlinks' sole discretion, Interlinks may revoke access to your Internet services account for inappropriate usage. To ensure that all connections are in active use, each call in account is monitored for activity. If a connection is inactive for 15 minutes the connection will be dropped. 6.Privacy While every reasonable effort is made to ensure privacy of your material, Interlinks does not guarantee privacy of your files and E-mail. If you want complete privacy, encryption software is available from software vendors. 7.Reselling Interlinks services, including, but not limited to, dial-up accounts, telnet accounts, webhosting and web design cannot be resold without permission from and agreement with Interlinks. Any customer found using Interlinks for the purpose of reselling without written permission from Interlinks may have their account immediately terminated without refund. 8.Customer Support Interlinks maintains two types of Customer Support. 1) Online Support: Email support questions can be sent to support@interlinks.net 2) Voice Support: Interlinks' voice line is (905)404-0810. Official voice support hours are 10:00am to 6:00pm Monday through Wednesday, 10:00am to 8:00pm Thurdsday through Friday, and 10:00am to 6:00pm Saturday. There are many books and online resources that will assist you in making the most out of your time on the Internet. Training classes are offered by Interlinks, call (905)404-0810 for details. 9.Warranties and Guarantees Interlinks makes no warranties or guarantees of any kind, either expressed or implied. Interlinks takes no responsibility for any damages suffered by a customer using Internet services. This includes, but is not limited to, loss of data, information that is not delivered and/or delivered with errors or omissions, service interruptions of any type, undesired email, or any litigation arising from the use of Internet services. 10.Unlimited Plan You understand that this account type is based on intermittent personal dial-up usage. Interlinks reserves the right to discontinue services to any users who are abusing the system at Interlinks' sole discretion. 11.Concurrent Login Sessions Each Interlinks Internet user account is intended for one concurrent connection to the Internet. As such, you hereby agree that should you, for any reason, abuse this right by having concurrent log in sessions using a single username and password, your Interlinks Internet Account will be automatically disabled, and upon repeat occurrence charged an additional fee of thirty dollars ($30.00) for each such occurrence of a concurrent login session. As between Interlinks and yourself, you are better able and suited to implement the appropriate physical and procedural impediments to the improper use of and to supervise your Interlinks Internet account. As such, you agree and acknowledge that your Interlinks Internet account and password protection shall be your own responsibility. 12.Disputes Account holders must notify Interlinks immediately if there is a dispute with regards to the amount charged for their account. Interlinks will not acknowledge a dispute for a cancelled account after 3 months has elapsed from the time of cancellation. It is the customers responsibility to ensure that all automatic payments have been stopped within 3 months of account cancellation. 13.Acceptance of Terms By initiating an account with Interlinks, or use of any service, you are agreeing to all terms and conditions. Should you not agree to terms and conditions you must contact Interlinks, and provide Interlinks written notification within five days of account initiation, to cancel service. Notices of non-acceptance can be faxed to (905)404-0428 with your account name and the word "cancel". Any other actions or lack of action will be considered acceptance of all terms and conditions. These terms and conditions supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted. No condoning, excusing or overlooking of any default by the account holder at any time and no failure to enforce the terms at any time shall be a waiver of any of the terms and conditions of this agreement.
